Buying Process
In Bulgaria a foreigner may not own land. This is fine if you are buying a flat, because flats are usually leashold, but in order to own a property and the land it stands on, you must do so using a Bulgarian Limited Company to purchase it.
This is not a problem, since the Limited Company is a recognised structure in Bulgarian Law, and is simple to form. There may also be an advantage to this structure when it comes to selling your property and this could offset the cost of formation.
Once you have found a property that you wish to purchase, our Lawyer will commence the procedure of Company Formation and Property Transfer.
As well as forming the company, we will take care of all the legal requirements and registrations with the various authorities: we can also provide the services necessary to maintain your company correctly each year. Please note that our charges are very low compared to some others that you will see advertised, and we will offer a complete service and support to you after the sale has gone through.
The first stage of the buying process consists of a Pre-Contract signed by The Seller and The Buyer, agreeing the price and completion-date. This is a binding contract between the parties that offers protection to both of them in the event of one party failing to complete the transaction. Like all documents, this will be translated into English and will be certified .
Once the company has been formed and registered, the Buyer and Seller, or their appointed representatives will go to the Notary Public's office and complete the purchase.
After the registration of your title, you will receive a Land Certificate, as in the UK, showing your title to the property, which you may have translated into english if you wish - you are then the registered owner of a Bulgarian Property.
Many Agents seem to avoid displaying the cost-of-purchase and their fees on their websites; no doubt preferring to wait until you have made a buying-decision before revealing them. We prefer to list our charges, which we think, are competitive in the marketplace.
When you sign the Pre-Contract to Purchase, you will need to pay us:

10% of the Purchase Price as Deposit.

The Company Formation costs of £395 ( or £495.00 if this is a remote purchase ).

Property Transfer charges of £195.00 ( Including the basic tax charge ).

Our commission of 3%. or £420.00, whichever is the greater.
Before a company can be formed, you must open a company bank account and would usually need to deposit £1800.00 into it, as the initial capital of your company. You can arrange a transfer via your bank, or we can set up the account using our funds, for a small extra fee.
Most other Agents will require you to carry a large amount of cash with you when you visit Bulgaria, since payment by cheque take a very long time to process, and credit cards have strict limits and charges, on them. You can avoid this risk by making your payment into our Client-Account, in the UK, with us making the necessary payments for you in Bulgaria : we can offer you this service whether you are buying through us or another agent.
It is also possible to purchase without visiting Bulgaria. People are often too busy to visit and view property, so we offer a service that allows you to make a purchase without having to travel to Bulgaria; completing the procedures of Company Registration and Land Transfer from the UK.
